Trust Formation (excluding Charitable Trusts)

A Trust is a legal way of validly protecting some, all or specific assets owned by you, for either yourself, your family or specific people (called beneficiaries under Deed of Trust).

 

When forming a Trust, you will need to comply with Anti-Money Laundering (AML) Legislation. This in practice means that you need to tell us the identity of all persons associated with the Trust, provide their valid proof of identity and proof of residential address, and specify the nature and intent of the Trust.

 

In certain cases, you may need to disclose the source of funds for the Trust.

 

We make it simple for you by providing you with a Trust Form to help you to think about the various aspects required when forming a Trust.

 

As part of our service, we will apply for an IRD No. for your Trust with Inland Revenue Department (IRD).

 

We can also assist you with drawing up papers should you decide it is time to wind up your Trust.

 

As part of this service, we will liaise with IRD and inform IRD of vesting (winding up) of your Trust.

 

You may need to see an accountant prior or at the same time to ensure that your tax returns are complete when this is done.
