Anti-Money Laundering (AML)

RKS Legal Limited (“the Firm”) is required to comply with the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 which is referred to as AML legislation here.

To comply with AML Legislation, the Firm is now required to conduct a risk assessment on every client. Clients include both existing clients and any prospective clients of the Firm. As part of this, the Firm must collect and verify information from all clients relating to all matters that the Firm is likely to work on.

This verification must be done before the Firm provides any services to its clients. The information that the Firm must collect from you includes your full name, your date of birth and your residential address. You can provide this information by showing your passport and/or driver’s licence to us, and a document such as electricity bill (which must not be more than 3 months’ old) showing your current residential address.

For example, if you are intending to consult the Firm regarding any Trust or Company, the Firm will need to find out information about the people involved with the Trust or Company, and obtain the information mentioned above. The Firm may also need to ask you for further information, and we may need to enquire about the nature and purpose of the proposed work that you are asking us to complete for you. The Firm may also be required to seek and retain from you information concerning the source of funds used to complete the transaction.

If you do not provide the required information, the Firm will not be able to act for you.

If the Firm has acted for you in the past, it is still required to complete risk assessment on every new transaction, and obtain the information mentioned above. So before the Firm starts working on any new matter, we will let you know what information is required and what documents need to be provided and verified by the Firm.

Please contact the director Rajesh Kumar Sharma by email at rajesh@rkslegal.co.nz if you want further information.
